As of November 25, 2023, all subclass 482 visa holders are eligible to apply for permanent residency in Australia. However, there are eligibility criteria to meet, such as:
Holding a 482 visa for a specified period
Meeting English language requirements
Nominations and sponsorships
Positive skill assessment from relevant authorities
Meeting health and character requirements
A business may also sponsor the visa holder for permanent residency after three years of work as a 482 visa holder. This is under the 186 visa or 187 visa Temporary residency transition stream.
Those over the age of 45 can also get PR on a standard 482 visa, but they must earn above the high-income threshold.
The three main parts to the 482 visa application are: Sponsorship, Labour agreement, Nomination.
The visa was introduced on March 19, 2019, and replaced the Subclass 457 visa.
To apply for a Subclass 482 visa, you must first be nominated by an approved business. The employer or visa applicant can pay the visa application fees, depending on what is negotiated between the two parties.
To be eligible for a 482 visa as a chef, you need to have at least two years of full-time work experience as a chef. This work experience must be relevant to the position you're being nominated for in Australia.
The English requirements for a 482 visa include:
IELTS: A minimum score of 5.0 in each test component
PTE Academic: A minimum score of 36 in each test component
CAE Cambridge Advanced: A minimum score of 154 in each test component
This visa is for skilled workers nominated by employers who have a Labour Agreement. It lets you live and work in Australia temporarily. Labour agreements are developed between the Australian Government (represented by the Department) and employers.
Significant changes to the Temporary Skill Shortage (TSS) visa and the Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (ENS) have opened up a broader and more accessible pathway to permanent residency for skilled workers in Australia. Effective from November 25, 2023, these reforms pave the way for a simplified and more inclusive process for overseas talent to secure permanent residency status.
Key among these changes is the expansion of the TRT PR pathway to include a wider range of occupations, no longer limited to the Skilled Migration Occupation Lists. This means that skilled workers across diverse industries, including business, commerce, and finance, now have a clear and achievable path to permanent residency.
